EXCEPTIONS AND EXEMPTIONS ON ENTRY REQUIREMENTS
1. General
1.1. Scope related accredited professional training
  • If an applicant wants to register as full certified and has passed successfully (1) experience audit, (2) knowledge test and (3) skillstest the applicant is exempt for the obligation to complete an accredited professional trainingprogram.
1.2. Country Romania
  • Exemption for all certificate holders in Romania.
  • As no suitable insurance solutions are available the full certified certificate holder is exempt for the obligation to have an liability insurance policy.
1.3. Country South Africa
1.3.1. Liability insurance
  • Liability insurance is not required for applicants in South Africa however is appreciated greatly.
  • This decision is based upon the fact that for the applicable country - liability insurance is not relevant for the mass GNG scope.
  • This decision is applicable to all practitioners in South Africa.
  • No further action is required by applicants/certificate holders in order to satisfy this criteria else wise.
1.3.2. Company registration
  • Company Registration is not required for private professionals in South Africa.
  • This decision is based upon the fact that a large portion of the professional market in South Africa operate their practice as individuals.
  • This decision is only for private professionals who practice their profession as a private entity. Any practitioner working for or under a company must provide proof of registration.
  • All practitioners who apply for this non-conformity to provide a letter stating same.
1.3.3. Grandfathering during ADR / mediation pilot 2018/2019
Together with some South African professional bodies and individual mediators, we organize a pilot on ADR/mediation.
The pilot ends Dec 31, 2019. As part of the pilot, specific entry requirements apply, see below:
  • If registered with an official South African ADR / arbitration / mediation / conflictcoaching / negotation body OR if completed an ADR professional course with an ADR Register accredited agency, no costs till Dec 31, 2019;
  • Required documents: (1) application form (2) proof of membership existing professional body OR proof of completed accredited mediation education / training + proof of active mediatorship (such as website, letter of reference)
2. For arbitrators
2.1. If law study completed
  • If an applicant wants to register as arbitrator and has completed a law study (higher or academic level) the applicant is exempt for the obligation to complete an accredited professional training programme and the knowledge test.
3. For mediators
3.1. If registered as (former) NMI | MFN mediator or with the Belgium Federal Mediators Committee
  • Exemption for (1) letter of good conduct (2) client reference letters (3) education certificate(s) (4) knowledge test (5) skills test
3.2. Title court mediator
  • Deviation for full mediators.
  • Only for full certified mediators. Not open for the associate mediators.
  • The court mediator complies with the criteria of the national authority in which the company has its official seat. Registration as court mediator is on a voluntary basis only. Additional costs will be charged.
3.3. Title family mediator
  • Deviation for full mediators.
  • Only for full certified mediators. Not open for the associate mediators.
  • The family court mediator complies with the criteria of the national authority in which the company has its official seat. Registration as court mediator is on a voluntary basis only. Additional costs will be charged.
4. For negotiators
4.1. Content-negotiator
  • Deviation experience test. In addition to the regular experience test criteria the candidate content-negotiator must show proof of specific content based knowledge and skills on expert-level.
4.2. Master-negotiator
  • Exception for all registered and certified arbitrators and mediators.
  • The title master-negotiator is included in the registration as arbitrator or mediator. No extra procedure applies.
  • If not registered as arbitrator or mediator: the candidate master-negotiator must have completed (1) basic training content-mediator and (2) application training master-negotiator (or an all in one training).
